The following list represents all hospitals that are eligible to have their wage
index increased by the out-migration adjustment listed in this table. This adjustment
is effective for 3 years. Hospitals cannot receive the out-migration adjustment
if they are reclassified under section 1886(d)(10) of the Act or redesignated
under section 1886(d)(8)(B) of the Act. Hospitals that have already
been reclassified under section 1886(d)(10) of the Act or redesignated under
section 1886(d)(8)(B) of the Act are designated with an asterisk. We automatically
assumed that hospitals that have already been reclassified under section 1886(d)(10) of the
Act or redesignated under section 1886(d)(8)(B) of the Act wished to retain their
reclassification/redesignation status and waive the application of the out-migration
adjustment. Section 1886(d)(10) hospitals that wished to receive the out-migration
"adjustment, rather than their reclassification, had to follow the termination/withdrawal "
procedures specified in 42 CFR 412.273 and section III.H.3. of the preamble of the
"proposed rule. Otherwise, they were deemed to have waived the out-migration "
adjustment. Hospitals redesignated under section 1886(d)(8)(B) of the Act were
"deemed to have waived the out-migration adjustment, unless they explicitly notified CMS "
that they elected to receive the out?migration adjustment instead within the required number of days
"from the FY 2012 IPPS/LTCH proposed rule. (We note that, the ordinary 45-day deadline was extended"
this fiscal year). Waiver of reclassification under 1886(d)(8)(B) of the Act in order to receive
the out-migration adjustment is effective for the full 3 years of eligibility.
" Providers should keep track of their 3-year period to ensure that if they, "
"again, qualify for an out-migration adjustment, they follow the 45-day procedure for waiving "
their Lugar status under 1886(d)(8)(B) of the Act.
